1. Agreement to Terms
By accessing and using The Learning Hive Academy website, services or resources (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these terms, you may not access or use our Services.
2. About The Learning Hive Academy
The Learning Hive Academy Pty Ltd (ACN 683 016 873), as trustee for The Coleman Family Trust (ABN 99 795 335 657), operates this platform to provide tutoring services, educational blogs, digital videos and online learning resources primarily focused on Australian secondary education.
3. Description of Services
3.1 Educational Services
We provide:
- One-on-one tutoring services
- Educational blog content and articles
- Digital video resources and tutorials
- Study tips and learning strategies
- Access to supplementary educational content
3.2 Platform Features
Our platform includes:
- Access to educational resources
- Customer support services
3.3 Service Changes and Availability
- We reserve the right to modify, suspend or discontinue any part of our Services, content or platform features at any time without prior notice
- We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Services
4. Intellectual Property Rights
4.1 Our Content
All content on our platform, including but not limited to:
- Text, graphics, logos, icons and images
- Software, code and digital materials
- Blog posts, articles and educational resources
- Audio, video and interactive elements
is owned by The Learning Hive Academy or our licensors and is protected by copyright, trademark and other intellectual property laws.
4.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- Access and use our content for personal educational purposes
- View and learn from our blog posts, videos and resources
4.3 Restrictions
You may not:
- Distribute, share or resell our content to third parties
- Modify, adapt or create derivative works
- Use content for commercial purposes
- Attempt to reverse engineer or extract source materials
- Remove copyright notices or proprietary markings
5. Prohibited Uses
You agree not to use our Services to:
5.1 Illegal Activities
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Engage in fraudulent or deceptive practices
5.2 Harmful Conduct
- Harass, abuse or harm other users
- Distribute malware, viruses or harmful code
- Attempt to gain unauthorised access to our systems
- Interfere with the proper functioning of our Services
5.3 Content Violations
- Upload or share inappropriate, offensive or illegal content
- Impersonate others or provide false information
- Violate the privacy rights of others
5.4 User Submissions and Feedback
- If you submit feedback, suggestions, ideas, reviews, comments or other materials ("Submissions") to us, you grant The Learning Hive Academy a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, translate and distribute such Submissions in any medium
- You represent and warrant that your Submissions do not violate any third-party rights, including copyright, trademark, privacy or other personal or proprietary rights
- We have no obligation to (a) keep Submissions confidential, (b) compensate you for Submissions or (c) respond to Submissions
- We reserve the right, but are not obligated, to monitor, edit or remove Submissions that we determine in our sole discretion to be unlawful, offensive or otherwise objectionable
6. Billing and Payments
6.1 Payment Methods and Security
The Learning Hive Academy uses a transparent, automated billing system. Your credit/debit card details are stored on our secure payment platform. All lesson records, invoices and payment records are available on your TeachWorks account. All credit/debit card details are securely encrypted, are kept confidential and are deleted from our system once tutoring has ceased.
6.2 Pay As You Go (PAYG) Billing
For PAYG, credit/debit cards are automatically billed each fortnight, according to our billing cycle. Payments are typically processed every second Monday and are for all lessons that took place in the previous 14 days. Occasionally, the day payments are processed may change (e.g. if the Monday lands on a public holiday). However, the fortnightly billing cycle itself does not change and is always 14 days in length, running from Monday (day 1) through to the following Sunday (day 14).
Example using imaginary dates:
- The billing cycle runs from Monday 1st - Sunday 14th
- Monday 15th is billing day
- On Monday 15th, you are billed for all lessons that occurred in the previous 14 days (Monday 1st - Sunday 14th)
6.3 Prepaid 10-Hour Packages
For Prepaid 10-Hour Packages, you will be emailed an invoice each time a package is issued and we will automatically charge the payment to your credit/debit card 3 days later. Prepaid 10-Hour Packages are automatically renewed when your unused credit drops below 2 hours.
Prepaid Package Benefit: Receive a $50 discount when you pay for 10 hours in advance. This is a great option for students happy for a long-term commitment with their tutor.
6.4 Switching Billing Options
You may switch from PAYG to Prepaid or from Prepaid to PAYG at any time. Simply contact us at hello@thelearninghive.academy to have your billing settings changed.
6.5 Other Services
For non-tutoring services or resources, prices are displayed in Australian Dollars (AUD) and payment processing is handled securely through Stripe.
7. Weekly Tutoring, Lesson Rescheduling and Cancellations
7.1 Commitment to Weekly Tutoring
We only take up students who are after weekly tutoring. Since we have a highly-skilled intimate team, we believe that our tutors can offer the most value to students who can commit to regular tutoring lessons. While lesson rescheduling and the occasional cancellation is acceptable, a student who shows a lack of commitment will be let go if they do not demonstrate a willingness to maintain consistent weekly tutoring. This is so we can offer tutors to other students on our waiting list who desire regular tutoring.
7.2 Cancellation and Rescheduling Policy
To reschedule or cancel a session, contact your tutor directly at least 24 hours PRIOR to the session. If you reschedule or cancel a session with less than 24 hours notice, charges do apply.
7.3 Failure to Attend
If you fail to attend weekly lessons without first contacting us at hello@thelearninghive.academy to obtain approval or to give us termination notice, you may be charged a termination fee (equivalent to 1 PAYG hour) if it has been more than 21 days since your last lesson.

8. Termination of Tutoring
8.1 No Lock-In Contracts
We do not have lock-in contracts. If you are not 100% satisfied, you can cease tutoring at any time. If you would like to change tutors for any reason, this can also be organised for you. Please contact us directly at hello@thelearninghive.academy.
8.2 Termination Policy

8.3 Termination by You
- You may terminate your tutoring arrangement at any time by contacting us
- Termination does not entitle you to refunds for unused prepaid hours, except as outlined in our Information Pack
8.4 Termination by Us
We may terminate or suspend your tutoring services if you:
- Violate these Terms or our policies
- Show a consistent lack of commitment to weekly tutoring
- Fail to pay required fees
- Engage in inappropriate or harmful behaviour
9. Refunds for Tutoring
9.1 Cancelling or Rescheduling a Single Lesson
Please contact your tutor directly to cancel any upcoming lessons, remember you need to give them at least 24 hours notice or charges apply. We charge AFTER lessons are attended, according to our fortnightly billing cycle. Unless we have made a billing error (which we will be happy to amend), you will not be charged for cancelled lessons; therefore, no refund is required.
9.2 Terminating Tutoring Permanently
To terminate tutoring permanently:
- Contact your tutor directly to cancel any upcoming lessons (remember you need to give them at least 24 hours notice or charges apply).
- Notify The Learning Hive Academy by emailing us at hello@thelearninghive.academy.
9.3 PAYG Students
You must notify The Learning Hive Academy within 21 days of the last lesson you attended. If you haven't attended a lesson yet, you must notify us within 21 days of completing the sign-up form. Failure to contact us within 21 days will result in a cancellation fee (equivalent to 1 PAYG hour). Any unpaid lessons will be billed as per usual at the end of the current fortnightly billing cycle.
9.4 Prepaid 10-Hour Package Students
Any unused balance will be refunded, minus the full price of 1 PAYG hour. Any hours previously used on the current package will be charged at PAYG price.
Example: Sarah has purchased a Prepaid 10-Hour Package for $900. She has only used 6 hours and wishes to terminate tutoring and obtain a refund. Her refund will be calculated as follows:
- 6 hours used @ $95/hr (PAYG price) = $570
- Termination fee (for administrative costs) = $95
- $570 + $95 = $665
- $900 (original amount paid) − $665 = $235 refund
9.5 Refund Processing
You will be refunded at the end of our current fortnightly billing cycle. Once processed, refunds can take 5–10 business days to reach your account.
If there is not enough credit remaining to pay the PAYG lessons plus the termination penalty, no refund will be given.
10. Content Accuracy and Disclaimers
10.1 Educational Content Disclaimer
- Our tutoring and educational content is designed to supplement, not replace, formal education
- We strive for accuracy but cannot guarantee that all content is error-free
- Educational outcomes may vary based on individual effort and circumstances
- We are not affiliated with or endorsed by curriculum and assessment authorities
10.2 Curriculum Authority Disclaimer
The Learning Hive Academy is not affiliated with, nor endorsed by, any state or territory Curriculum and Assessment Authority. These authorities provide the only official, up-to-date versions of publications, study designs and information about senior secondary certificates of education. All curriculum names, course titles and examination materials remain the property of their respective authorities.
10.3 Third-Party Content
- We may include links to third-party websites or resources
- We do not endorse or take responsibility for third-party content
- Your use of third-party services is subject to their terms and conditions
10.4 Website Information Disclaimer
- Information made available on our website, blog, videos or other resources may not always be accurate, complete or up to date
- Such information is provided for general educational and informational purposes only and should not be relied upon as the sole basis for making decisions
- We do not undertake an obligation to update any information except as required by law
10.5 Third-Party Tools
- We may provide you with access to optional third-party tools or integrations over which we have no control or input
- You acknowledge and agree that such tools are provided "as is" and "as available" without warranties of any kind
- Your use of optional third-party tools offered through our Services is entirely at your own risk and discretion and may be subject to the third-party provider's own terms
- We are not liable for any loss or damage arising from your use of third-party tools or integrations
11. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use and protect your personal information. By using our Services, you consent to the collection and use of information as outlined in our Privacy Policy.
12. Limitation of Liability
To the maximum extent permitted by law:
12.1 Disclaimer of Warranties
- Our Services are provided "as is" without warranties of any kind
- We disclaim all warranties, whether express, implied or statutory
- We do not warrant that our Services will be uninterrupted or error-free
12.2 Limitation of Damages
- Our liability is limited to the amount you paid for the specific service
- We are not liable for indirect, incidental or consequential damages
- This includes lost profits, data loss or educational opportunities
13. Indemnification
You agree to indemnify and hold harmless The Learning Hive Academy, its officers, directors, employees and agents from any claims, losses, damages or expenses arising from:
- Your violation of these Terms
- Your misuse of our Services
- Your violation of any third-party rights
- Any content you submit or share through our platform
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last Updated" date
- We will notify you through our website or email
- Continued use of our Services constitutes acceptance of the updated Terms
- Material changes may require your explicit consent
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts of Australia.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
17. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and The Learning Hive Academy regarding your use of our Services.

19. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, term or condition, right or remedy implied or imposed by the Competition and Consumer Act 2010 (Cth) or any other applicable Australian consumer protection law that cannot lawfully be excluded, restricted or modified.
